Terms & Conditions

At P.A.T.42.2 RUNNING, we pride ourselves for providing a personal level of running coaching and personal training services of highest quality and we look forward to working with you and helping you achieve your personal goals. To help us provide a professional, motivating and enjoyable experience for you and all our clients, please read through these terms and conditions. USE OF LIKENESS.

The participant gives P.A.T.42.2 RUNNING the irrevocable right to use my name/ photograph/ image / video recording/ and likeness (“My Image”) in all forms and manner including but not limited to publication on Web Sites, and other publications as released to or by P.A.T.42.2 RUNNING. I understand that P.A.T.42.2 RUNNING cannot control unauthorized use of My Image by persons not associated with P.A.T.42.2 RUNNING once My Image has been published.

 

EXCLUSIONS:

  • The services provided do not cover any event entry fees or travel arrangements unless otherwise specified
  • The participant has sole responsibility for all personal possessions during training.
  • The participant acknowledges that any training material provided including training plans and strength programs are to be used as a guide only.

 

HEALTH SCREENING AND MEDICAL HISTORY.

We will ask you to fill out and sign our health screening and medical history form at the time you sign up for our Personal Training Plan, Online Coaching, Personal Training and Running Form Analysis services. You must inform your coach/ personal trainer of any relevant injury or illness and obtain a medical clearance from your medical specialist prior to beginning (or restarting) training if there are any medical concerns. This form is not required for participants that solely take part in our Group Sessions and Marathon Club.

 

PERSONAL TRAINING PLAN AND ONLINE COACHING SERVICES.

Our diverse coaching services from bronze to platinum level cater for everyone. We offer different levels of online coaching and feedback for each level and price range as defined on our website:

  • Our Bronze Level Training Plan requires the full amount of upfront payment without any contract. After an initial consultation by email, this level of service does not include online coaching and personal feedback by email going forward. Group training sessions, personal training and marathon club membership can be purchased separately.
  • Our Silver Level Training Plan comes either in 3 or 6 month subscriptions and can be extended by 3 or 6 months only with possibility to upgrade to Gold or Platinum level at any point if availability exists. The minimum contract duration is 3 months and reoccurring payments are made on a monthly basis via direct debit. A 24 hour cooling off period applies before entering into a contract or membership. After an initial consultation in person or by phone call, this level of service includes a training plan review once every 6 to 8 weeks and 2 questions by email per month with your personal coach. Email response by coach will be within 24h (except weekends and public holidays). Group Training Sessions, Personal Training and annual Marathon Club memberships can be purchased separately.
  • Our Gold Level Online Coaching comes either in 3 or 6 month subscriptions and can be extended by 3 or 6 months only with possibility to upgrade to Platinum level at any point if availability exists. It is possible to downgrade to Silver level after the initial 3 months only. The minimum contract duration is 3 months and reoccurring payments are made on a monthly direct debit. A 24 hour cooling off period applies before entering into a contract or membership. After an initial consultation in person or by phone call, this level of service includes a training plan review once per month. For extensive email contact; a reasonable amount of contact is considered to be 2 questions per week (either by email or one phone call) with your personal coach. Email response by coach will be within 24h (except weekends and public holidays). Places for this Gold Level Service are limited due to availability of personal coach. Our Group run sessions and annual Marathon Club membership is included. Personal Training can be purchased separately.
  • Our Platinum Level Personal Coaching comes as a 12 week program that includes 12x 60 minutes 1-on-1 personal training/ coaching session including an initial assessment of running form analysis and functional strength. The minimum contract duration is 12 weeks and reoccurring payments are made on a monthly basis via direct debit. A 24 hour cooling off period applies before entering into a contract or membership. In addition, this level includes all of the Gold Level Online Coaching services, including a personal running training plan and strength program, plus unlimited personal e-mail exchange with your coach. Additional personal training sessions can be purchased for $80 per hour. Extra travel fees to train you outside our regular area of service might apply. Places for this Platinum Level service are limited due to Pat’s availability.

 

ALTERATIONS.

P.A.T.42.2 RUNNING and its partners reserve the right at any time to make any alteration to training sessions and services provided should they become necessary due to circumstances beyond their control and undertake to inform participants as soon as possible. We also take our right to alter our business policies including these terms and conditions at any time and that any such changes are effective immediately, binding on the client and will be updated on our website.

Liability Waiver

EXCLUSION OF LIABILITY AND WAIVER OF RIGHT TO SUE.

In consideration of acceptance for participation in and activity with P.A.T.42.2 RUNNING, the participant agrees to the following conditions:

 

AUTHORITY TO REGISTER/ MINIMUM AGE TO PARTICIPATE.

The participant confirms that he or she is a minimum of 18 years of age when signing up with P.A.T.42.2 RUNNING and before taking part in any coaching or personal training activity with P.A.T.42.2 RUNNING. If a person is not a minimum of 18 years of age, their legal parent or guardian has to create a Mindbody online account first and agree to our liability waiver and terms and conditions before adding the Child (under 18 year old) as a family member. All business policies including terms and conditions apply to both the parent/ guardian as well as the minor.

 

ASSUMPTION OF RISK.

The participant acknowledges a risk of injury in running and personal training and assumes and accepts all risks and hereby for themselves, their heirs, executors and administrators, waives the right to sue P.A.T.42.2 RUNNING for any injury in any way whatsoever arising from the training and releases and indemnifies P.A.T.42.2 RUNNING from and against any and all other claims, loss, liability, demands and proceedings arising out of or connected with their participation in the training. This release is a continuing release.

 

REPRESENTATIONS.

The participant declares that he/she is physically fit and further verifies that he/she has no pre-existing medical conditions or physical or intellectual impairments that may make participation unsafe for themselves or others. The participant consents to receiving medical treatment as may be deemed necessary in the event of injury, accident or illness during training.

 

RELEASE AND WAIVER OF LIABILITY.

P.A.T.42.2 RUNNING, its employees, agents, contractors and volunteers (“P.A.T.42.2 RUNNING ”) shall have no liability whatsoever to the participant, their dependants, heirs or legal representative for personal injury, accident, illness or death suffered by the participant arising in any way whatsoever from participation in training.

 

INDEMNITY.

You agree to indemnify, defend, and hold harmless P.A.T.42.2 RUNNING and all other persons associated with P.A.T.42.2 RUNNING, from all liabilities arising out of or in any way connected with (a) your participation in the services offered, including without limitation any liability caused by negligence (including any negligent rescue attempt), the action or inaction of P.A.T.42.2 RUNNING, (b) your use of P.A.T.42.2 RUNNING, or (c) any violation by you of any terms of this agreement and waiver and/or the terms of use located.

 

ACCEPTANCE.

You will in no way hold P.A.T.42.2 RUNNING or your coach/ personal trainer liable for any injuries or illness sustained. You also agree that you have no undisclosed injury or illness that may affect your ability to undertake rigorous exercise and to the best of your knowledge you are ready and able to undertake this exercise program.

CANCELLATION WINDOW.

The cancellation window for all P.A.T.42.2 RUNNING services is 24 hours notice. If you miss a scheduled appointment or cancel with less than 24 hours notice, you will be charged for the scheduled training session (except under special circumstances or in case of emergency).

  • 24 hours notice must be given for cancellation of any booked service, including but not limited to group training sessions (classes), personal training/ coaching sessions (appointments) prior to the start of the session. Courses (enrolments), training plans/ online coaching (contracts) and memberships can be cancelled or rescheduled up to 24 hours from the time of purchase.
  • For any bookings administered through our website and Mindbody Online, cancellations have to be done by the client by logging into their Mindbody Online account.
  • For any other bookings confirmed in person, by email or phone call, notice must be given to the coach/ personal trainer by phone call or email info@pat422running.com.au to cancel or reschedule any service. The service is only cancelled or rescheduled if the notice has been given on time and been confirmed by the coach/ personal trainer.
  • A refund is only possible if the minimum notice of 24 hours is given.
  • A $10 administration fee will be deducted from all refunds to cover website booking costs and administration time.
  • If you sign up for a booked service with less than 24 hours to the start time for the service, no cancellation or refund is possible. i.e. you sign up at 7am for a 4pm training session, then the session cannot be cancelled.

 

RESCHEDULING A TRAINING SESSION.

We understand that sometimes you may need to reschedule an appointment. We will do our best to accommodate your request.

  • 12 hours notice must be given for rescheduling of any booked training session, including group training sessions (classes), and 1-on-1 personal training/ coaching (appointments), but excluding courses (enrolments) and training plans/ online coaching (contracts).
  • A session can only be rescheduled once and the maximum duration it can be rescheduled is 30 days.
  • If less than 12 hours notice is given a session cannot be rescheduled and a refund is not possible.
  • For any bookings administered through our website and Mindbody online, rescheduling has to be done by the client by logging into their Mindbody online account.
  • For any other bookings confirmed in person, by email or phone call, notice must be given to the coach/ personal trainer by phone call or email info@pat422running.com.au to reschedule any service. The service is only rescheduled if the notice has been given on time and been confirmed by the coach/ personal trainer.

 

COURSES, TRAINING PLANS, ONLINE COACHING SERVICES AND MEMBERSHIP.

Courses (enrolments), Training Plans and Online Coaching Services (contracts) have a minimum duration and cannot be cancelled during that time

  • The minimum duration for any course equals the full duration of that course and cannot be cancelled during the course dates as advertised.
  • The minimum duration for a Training Plan/ Online Coaching is 3 months (12 weeks) and the associated costs are non-refundable.
  • A 24 hour cooling off period applies before entering into a contract or membership.
  • The annual Marathon Club memberships expire by December 31st of that year. Memberships are non-refundable and cannot be cancelled or rescheduled into the following year.

 

CANCELLATION DUE TO SEVER WEATHER CONDITIONS AND OTHER REASONS.

In the event of extreme weather conditions (i.e. heavy rain, lighting storms and flooding) or other threatening circumstances, a training session may be cancelled to ensure the safety of participants. The coach/ personal trainer is at his/ her sole discretion to reschedule the event to a later time or day subject to availability. Participants will be advised as soon as possible by either email, phone or a facebook post.

If conditions deteriorate during the session and it is considered to be placing the participants at risk, the coach/ personal trainer will make the decision to call off the session and for participants to either safety return to the start or seek a safe location until conditions improve. It is noted that running sessions will be held in rain and it is only in extreme weather conditions that they will be cancelled.

If any of our services cannot be delivered or can only be delivered partially by P.A.T.42.2 RUNNING for whatever reason, the business owner is at his/ her sole discretion to offer either rescheduling of that service (i.e. class or appointment) or refund that can either be in full (i.e. a product) or a pro-rata based (i.e. a contract).

Purchase Policy

EZDEBIT.

All payments through our website, Mindbody Online and the Mindbody App for services and products are administrated by Ezidebit, which is an Australian payment gateway to take payments online. Merchant fees are paid by us and the prices advertised on our website are the final prices our clients pay, without additional fees.

Direct debit is our preferred payment method and all reoccurring payments for contracts are done through direct debit only. Contracts have a minimum duration as advertised on our website and cannot be cancelled during that time. A 24 hour cooling off period applies before entering into a contract or membership.

In addition, we accept credit card payments through Visa or Master cards for one-time payments. However, we do not accept payments by American Express (AMEX) or Diners. “Ezibebit HealthFit MB” will appear on your credit card statement for credit card transactions.

INVOICE.

Payments that cannot be made through our website will be invoiced. This is particularly common for our group training sessions with partners, corporate teams and sporting clubs. Payments are invoiced monthly and can be paid by bank transfer or via cheque.  Full payments are due within 7 days from the invoice date.

Refund Policy

A refund is only possible if the minimum notice of 24 hours is given as defined in our CANCELLATION POLICY.

A $10 administration fee will be deducted from all refunds to cover website booking costs and administration time.

In case of significant personal circumstances that prevents participating in our Courses, Training Plans or Online Coaching services completely, a pro-rata based refund for the remainder of the payment can be considered by the business owner. We pride ourselves for our personal coaching services and will act as flexibly as possible when it comes to changing your training plan to a different goal event, rescheduling or extending your contract if required. i.e. you sign up for a training plan to train for Gold Coast Marathon in July, but decide to reschedule your goal event to Brisbane Marathon in August instead.

All refunds will be decided by the business owner on a case by case basis.

If the service cannot be delivery or can only be delivered partially by P.A.T.42.2 RUNNING for whatever reason, the business owner is at his/ her sole discretion to offer either rescheduling of that service (i.e. class or appointment) or a pro-rata based refund (i.e. contract or product).
